Bank Account Frozen in China? Immediate Legal Steps for Overseas Companies

Legal response planning for a bank account frozen in China

A frozen China bank account can stop payroll, supplier payments, customs activity and customer collections overnight. For an overseas company, the first hours matter: preserve evidence, confirm the nature of the restriction and avoid actions that may worsen the position.

There is no universal “unfreeze application.” The correct route depends on why the account was restricted, which institution or authority imposed the measure, the affected amount and the governing procedure.

First, identify the type of restriction

Ask the account bank for the information it is permitted to provide: the nature of the restriction, account(s) affected, date, amount or scope, reference number, duration where available, and the entity that issued or requested the measure. A bank control based on customer-due-diligence or transaction concerns differs from a judicial preservation measure, an administrative investigation or a criminal case.

Question Why it matters Immediate action
Who imposed the restriction? Identifies the correct communication and procedural route. Record the authority, reference and bank contact.
What accounts and funds are affected? Defines the cash-flow impact and evidence needed. Prepare an account and transaction map.
What is the stated basis or concern? Determines whether the issue is judicial, regulatory, AML/KYC or operational. Preserve relevant notices and do not speculate.
Is there a deadline or duration? Shapes urgency and any available review steps. Calendar dates and instruct responsible team members.

Preserve evidence before it becomes fragmented

Create a controlled evidence file: bank notices, account statements, payment records, invoices, contracts, shipping and customs records where relevant, corporate-registration documents, beneficial-ownership information, correspondence and a timeline. Keep originals intact and ensure translations accurately reflect the source documents. Do not alter transaction records, create backdated documentation or route funds through another person or account to bypass the restriction.

Protect the business while the facts are assessed

Map urgent obligations such as payroll, tax, supplier and customer commitments. Explain the operational impact through documented facts, not unsupported assertions. The response plan may include lawful alternatives for future payments, subject to legal advice and the bank’s requirements; it must never be used to evade a valid freeze.

Use the right channels

The bank is often the execution point, but it may not have authority to lift a measure imposed by another body. Communicate professionally with the bank, request the applicable process and submit responsive documents. Where an authority is involved, counsel can assess the notice, basis, evidence and available procedural communication route. China’s foreign-exchange account rules also show that account use is subject to regulatory oversight; cross-border payment documentation should be addressed carefully.

Should I move money through another account?
