Can a U.S. default judgment be enforced in China? Potentially, but the judgment creditor must first obtain recognition from a competent Chinese court and prove that the defendant received lawful notice and a fair opportunity to participate. For U.S. and European businesses, the decisive issue is often not the amount awarded abroad; it is whether the service record, finality evidence and Chinese enforcement plan can survive judicial review.
The short answer
A legally effective foreign civil or commercial judgment may be recognized and enforced in China under an applicable treaty or the principle of reciprocity. A Chinese court does not simply register the overseas judgment. It examines jurisdiction, finality, service and due process, conflicting proceedings or judgments, public policy and other statutory refusal grounds.

Why default judgments receive close scrutiny
When the defendant never appeared, a Chinese court needs reliable proof that the foreign proceedings respected the defendant’s right to be heard. The Beijing International Commercial Court’s official filing guidance states that an applicant relying on a default judgment should provide proof of lawful summons and response unless the judgment itself clearly records service.
- How and when was the complaint served?
- Was the service method permitted by the law of the rendering court?
- Did an applicable service treaty control the method?
- Did the defendant receive enough time to respond?
- Does the judgment state the service history and default clearly?
Five questions to answer before filing in China
1. Is the judgment final and legally effective?
Obtain a certified judgment and official evidence that it has taken effect. If an appeal, motion to vacate or other challenge is pending, assess how that affects finality before incurring translation and filing costs.
2. Did the foreign court have an acceptable jurisdictional basis?
The place of incorporation, domicile, contract performance, negotiated forum clause and location of the underlying transaction may matter. A judgment based only on an excessive or unrelated jurisdictional claim carries added risk.
3. Can service be proved document by document?
Preserve process-server affidavits, postal records, treaty certificates, translations, docket entries and the part of the judgment addressing service. Screenshots or informal email trails rarely replace formal proof.
4. Is there a treaty or a basis for reciprocity?
The applicable route depends on the country and judgment. The Supreme People’s Court’s official 2022 conference minutes provide important judicial guidance on reviewing foreign civil and commercial judgments, including reciprocity.
5. Are there reachable assets in China?
Recognition without a recovery target can produce a paper victory. Identify the debtor’s bank accounts, equity interests, receivables, real estate, vehicles, inventory and operating entities before filing where lawful.
A practical service-record scenario
Consider a U.S. supplier that wins a default money judgment against a Chinese buyer. The buyer ignored the case, but the record contains only an email copy of the complaint and no formal proof of service. The creditor’s immediate problem is not damages calculation. It is the evidentiary gap on notice. Counsel should reconstruct the service route, review treaty requirements and determine whether additional proceedings in the rendering court can clarify finality or service before a China application is filed. This is a representative scenario, not a claim about a specific client result.
