A Family Member Has Been Detained in China: What Information Should You Gather?

Scope: Mainland China; families of foreign nationals

You receive a brief message that a relative has been detained in China. The location is unclear, friends are repeating conflicting explanations and someone offers to arrange an immediate release for a fee.

When a foreign national is detained in China, the first practical task is to establish reliable facts and obtain appropriate legal assistance. Avoid building decisions around rumors or promises of a guaranteed outcome.

Create one verified information record

Write down the person’s full name, nationality, identity details, last known location and the source of the detention information. Preserve any official notice and identify the authority named in it. Record what has been confirmed and what remains unknown.

Note medication, urgent health needs and language issues so that these can be raised through appropriate channels. Keep one family contact responsible for coordinating updates.

Clarify the legal process

Not every restriction on liberty follows the same procedure. Counsel needs to determine the nature of the measure and the stage of the matter before advising on options.

China’s Criminal Procedure Law provides for the appointment of defense counsel from specified early stages; during investigation, defense representation is restricted to lawyers. Access and procedural arrangements must be assessed for the particular case. Official Criminal Procedure Law, Articles 34–39.

Use consular support appropriately

Contact the person’s embassy or consulate through its official channels. Consular assistance has a different function from criminal defense and cannot guarantee release or direct the local court. The available assistance depends on nationality and circumstances. UK guidance explaining consular assistance abroad.

Protect the integrity of the case

Preserve relevant records. Avoid public speculation, coordinated accounts or attempts to influence witnesses. Before transferring money to an intermediary, verify identity, professional status and the proposed work.

Need China criminal procedure advice for a relative? Contact Jinyuan Law Firm with a brief factual summary and the official notice details. Ask about representation, the information required for appointment and the next procedural steps. Send identity documents only through an agreed secure channel.

General information only. Advice depends on the facts and applicable jurisdiction. Contact does not by itself create a lawyer-client relationship. Local-law advice may be needed outside mainland China.
