To report fraud in China as an overseas victim, start with a structured criminal complaint and evidence package that connects the suspected deception, payment, loss and Chinese jurisdiction. A demand letter or civil claim may still be relevant, but a criminal report should explain why the facts potentially meet a criminal offense and give the public security organ usable leads rather than a large, unorganized document dump.
Is the dispute fraud or a civil contract breach?
Non-payment, late delivery or a failed investment does not automatically prove criminal fraud. Investigators will examine the alleged intent, representations, timing, use of funds, identity of the recipient, transaction pattern and surrounding conduct. Before reporting, counsel should test both routes: criminal reporting and civil litigation or asset preservation.

Criminal complaint evidence checklist
- Chronology of communications, promises, payments and discovery of loss
- Contracts, purchase orders, invoices and amendments
- Bank transfer confirmations and beneficiary account details
- Emails, platform messages and complete chat exports
- Company registry information and Chinese names of relevant persons
- Shipping, warehouse, customs or inspection records
- Website captures, advertisements and representations relied upon
- Identity documents and authority for the reporting company representative
- Loss calculation separating principal, fees, interest and consequential claims
- Known addresses, phone numbers, bank accounts, assets and other victims
What should the written report explain?
- Who the victim and suspected parties are.
- Where the key conduct and loss occurred.
- What representations were false or concealed.
- Why the evidence suggests criminal intent rather than ordinary non-performance.
- How much was paid and where the money went.
- Which original evidence can be produced.
- What investigation leads are available in China.
- Which authority is asked to accept and review the report.
How criminal reporting fits into Chinese procedure
The Supreme People’s Court’s published Criminal Procedure Law organizes criminal cases through filing, investigation, prosecution and trial. Public security organs generally investigate criminal cases, while procuratorates perform prosecution and legal-supervision functions. A reporting strategy should identify the competent organ and present jurisdiction facts clearly.
Can the victim seek compensation?
Victims may have procedural options concerning property loss, including a civil action incidental to criminal proceedings in qualifying circumstances. The official English text of China’s Criminal Law states that a person who causes economic loss through a crime may also bear compensation responsibility. The best route depends on the case, available assets and interaction with any separate civil claim.
A representative cross-border fraud scenario
A U.S. buyer wires deposits to an account named by a supposed Chinese supplier. The website disappears, the registered company denies receiving the funds and the contact begins using a different identity. A useful report should map the website, messages, beneficiary account, false company documents, shipping promises and loss into a single chronology, while counsel checks whether the account holder, IP evidence or related victims create a Chinese investigation lead. This is a representative scenario, not a specific client result.
Common reasons a report becomes difficult to assess
- The complaint describes conclusions but not the underlying acts.
- Evidence is untranslated, incomplete or out of chronological order.
- The payment path does not match the alleged perpetrator.
- The file omits the civil contract and prior settlement discussions.
- The victim cannot identify a Chinese jurisdictional connection.
- Loss figures combine unsupported future profits with transferred funds.
