An IP Complaint Took Down Your Listing: Build the Response Around the Right

Woman in suit reviews document with man.

Scope: International marketplaces; rights and platform rules vary by jurisdiction

Your best-selling listing disappears after an intellectual property complaint. The supplier says the product is legitimate, but the platform wants a response. Resubmitting the same invoice may not answer the actual allegation.

A marketplace IP complaint appeal needs to begin with the right involved: trademark, copyright, patent or another claim. Each raises different factual and legal questions.

Read the complaint precisely

Preserve the notice, affected listing, case number and deadlines. Identify the claimant, territory and the particular content or product feature challenged. A trademark complaint about authenticity differs from a copyright complaint about a photograph.

Save the listing as it appeared at the relevant time. Later edits may be sensible, but do not lose the record of what was originally published.

Match evidence to the allegation

Invoices may help explain sourcing without proving permission to use images or a brand in a particular way. Check licenses, distribution authorizations and the identity of the parties granting them. Distinguish a supplier’s assurance from independently verifiable rights.

For US copyright matters, a statutory counter-notification has legal conditions and consequences; it is not a generic appeal for every IP complaint. US Copyright Office Section 512 guidance.

Choose the appropriate response

Possible steps may include correcting content, submitting a supported appeal, seeking clarification or obtaining advice on the underlying dispute. Review the platform’s current procedure and the relevant national law. Do not admit infringement or accuse a competitor of dishonesty without understanding the evidence.

If a complaint appears malicious, preserve the basis for that assessment. A weak complaint and an intentionally abusive complaint are not necessarily the same.

Address the recurrence risk

Review sourcing records, listing permissions and staff approval procedures. Keep rights evidence tied to the actual item and marketplace. A successful appeal does not establish clearance for every future use.
