US and EU Customs Compliance: A Pre-Shipment Checklist

Woman in suit reviews document with man.

US and EU customs compliance begins before a shipment leaves the warehouse. Establish the responsible importer or declarant, verify the product facts, document classification, valuation and origin, and give the broker consistent instructions. A freight booking and a commercial invoice alone do not prove that the shipment is ready.

This checklist is for importers, exporters and operations teams investigating preventable holds, unexpected charges or inconsistent declarations. It is a review framework, not a tariff quotation or a guarantee of release.

Who checks the broker’s work?

CBP explains that an importer remains responsible for ensuring compliant importation even when using a customs broker. The practical consequence is to retain the product facts supplied to the broker and verify material declaration details. Read CBP’s guidance on using a customs broker.

Use a responsibility matrix naming who supplies specifications, who proposes a code, who approves the value, who keeps origin evidence and who receives notices. Avoid leaving these tasks with an unnamed “logistics team.”

Three decisions to document for each product

Decision Evidence to collect Question to resolve
Classification Composition, function, specifications and images Does the selected tariff classification fit the actual product?
Valuation Contracts, invoices, payments and relevant additional charges Has the correct valuation method and treatment been assessed?
Origin Manufacturing locations and production records What rule applies and which facts support the origin claim?

CBP’s Importing into the United States guide provides background on importer responsibilities and reasonable care. It is an older general guide; use current tariff materials and transaction-specific advice for rates or time-sensitive measures.

EU low-value imports: update the 2026 workflow

The Commission’s guidance, updated in July 2026, describes a temporary EUR 3 customs duty for covered consignments up to EUR 150 from 1 July 2026. Calculation is based on tariff-classification items, not simply the number of physical units. Scope and exceptions must be checked for the shipment. This is separate from VAT and from any handling-fee measure. See the official Commission guidance.

Ask the declarant to demonstrate the calculation on a sample mixed-product parcel. Record the classification assumptions, import date and treatment before using that result in checkout pricing. Do not copy a historical “under EUR 150 means no duty” rule into a current shipping policy.

Run these checks before dispatch

  1. Confirm the buyer, seller, inventory owner and customs roles.
  2. Match the product description to the actual goods and supporting specifications.
  3. Approve the classification, valuation and origin analysis.
  4. Review product-specific permits, restrictions and safety-document requirements with the appropriate specialist.
  5. Compare order, invoice, packing and broker data for discrepancies.
  6. Record responsibility for duties, additional costs, corrections and customer communications.
  7. Store the approved file where the team handling a customs enquiry can retrieve it.

For US entries, confirm current tariffs and low-value entry treatment at the transaction date. This article deliberately does not supply a universal US duty rate or duty-free threshold; origin, goods, timing and entry conditions matter.

Illustrative scenario: one product, conflicting descriptions

Hypothetical example, not a client result. Procurement calls a product an accessory, the supplier invoice calls it a machine part and the broker uses a generic description. The review team compares the technical specifications and asks for a documented classification decision before repeating the shipment. It also checks whether earlier entries require action through the applicable correction process.

Do not solve the problem by choosing the description associated with the lowest apparent duty. Correct the product master record and establish a change trigger when materials, function or manufacturing locations change.

What to do when a shipment is already held

Obtain the actual notice and distinguish a customs hold from a carrier’s document request. Identify the response deadline, preserve the submitted declaration and appoint one coordinator. Assemble the specific evidence requested and assess storage, return or other options under the relevant procedure. Do not promise the customer a release date that has not been confirmed.

Frequently asked questions

Does a supplier’s code settle classification?

Use it as an input for review. Retain the supporting reasoning and verify its suitability for the destination tariff system and actual goods.

Does an IOSS arrangement replace customs review?

No. IOSS concerns a particular VAT reporting mechanism. Customs classification, declaration data and other import requirements still need their own assessment.

Can the same file support repeated shipments?

A controlled product file can reduce repeated work. Add review triggers for specification changes, new origins, revised rules and different import arrangements.
