To enforce an arbitral award in China, begin by identifying the award and enforcement route accurately. The arbitration’s seat, the debtor’s location and the relevant legal arrangements can matter.

Build an enforcement file

Keep the award, arbitration agreement, procedural correspondence and documents identifying the parties. Record any correction, challenge, suspension or payment after the award. Ask the receiving lawyer which copies, translations and formalities the relevant court requires before ordering document services.

List the amount awarded separately from interest, costs and subsequent payments. This helps counsel determine what can properly be requested and prevents an avoidable dispute about calculation.

Investigate collectability

Organize lawful information about bank relationships, property, receivables and other business assets. Mark whether each lead is verified or only suspected. A supplier’s website or office address may identify a lead without establishing ownership of an enforceable asset.

Do not assume assets held by another group company belong to the award debtor. A separate legal basis would be needed to pursue another party.

Anticipate procedural objections

For qualifying foreign awards, the New York Convention contains limited grounds for refusing recognition or enforcement, including specified procedural and validity issues. Enforcement proceedings are not a general opportunity to retry the merits. Convention framework.

China’s Civil Procedure Law also addresses applications involving awards made outside its territory. Counsel should determine the correct court, deadlines and filing route for the specific award. Official statute.

Evaluate a payment proposal carefully

If the debtor offers instalments, compare available security, default consequences and the effect on pending proceedings before agreeing to withdraw anything.
