Scope: Foreign civil and commercial court judgments; mainland China
A court in your home country has ruled in your favor. The defendant’s assets, however, appear to be in mainland China. Sending the judgment to the debtor’s bank will not, by itself, produce payment.
Foreign judgment enforcement in China requires an assessment of recognition as well as collection. These are connected tasks, with different questions to answer.
Start with the judgment’s legal status
Identify the issuing country, court, case type and whether the judgment has taken legal effect. Preserve the complete decision and documents showing its status. A money judgment, interim order and family-status decision should not be treated as interchangeable.
China’s Civil Procedure Law provides for review under applicable treaties or reciprocity and specifies refusal grounds. These include certain jurisdictional defects, lack of proper notice or a reasonable opportunity to participate, fraud and conflicting decisions. Articles 298–301, official statute.
Do not generalize from “Europe.” The relevant country and judgment matter. A case involving France may require a different treaty analysis from one involving the UK or a US state court.
Preserve the procedural history
Request service records and relevant orders from the original legal team early, especially after a default judgment. A favorable outcome does not remove the need to explain how the defendant was notified.
Ask counsel to identify the applicable filing deadline promptly. Avoid waiting for every asset detail before obtaining procedural advice.
Check where value can be recovered
List verified asset information separately from assumptions about a corporate group. Recognition will not create assets or make an unrelated company responsible for the judgment debt.
Discuss the expected stages, costs and documents before commissioning translations or authentication. The receiving court’s requirements and the issuing jurisdiction should guide that work.

General information only. Advice depends on the facts and applicable jurisdiction. Contact does not by itself create a lawyer-client relationship. Local-law advice may be needed outside mainland China.
