Scope: Mainland China; overseas civil claimants
You may be certain that you were treated unfairly. A court still needs a legally supported claim and evidence connecting the defendant to the loss. That gap can be especially frustrating when your documents, witnesses and payments are spread across countries.
Preparing China civil litigation evidence begins with four questions. They help turn a personal account into a file that a lawyer can assess.
Who owes the obligation?
Identify the defendant’s legal identity and its connection to the transaction. The person who exchanged messages may be an employee, agent or unrelated intermediary. Keep documents showing whom you paid, who made the promise and who performed—or failed to perform—it.
Write down what remains uncertain. A disputed identity is an investigation task, not a detail to fill in with an assumption.
What do the original records show?
Preserve contracts, full message threads, payment confirmations and dated records of performance. Keep original digital files and their context. A cropped screenshot may omit the sender, date or surrounding explanation that makes the conversation understandable.
Create a short chronology with a document reference beside each event. Include unfavorable correspondence. Your lawyer needs to anticipate the other side’s account, including any allegation that you changed instructions or accepted performance.
What evidence might disappear?
Flag expiring account access, disappearing online listings and records held by others. Ask counsel about lawful collection and any appropriate preservation application. Do not access another person’s account or alter files to strengthen your position.
What outcome would make proceedings worthwhile?
Discuss the amount in dispute, available remedies, likely expense and known assets. A negotiated payment or other performance may better serve your objective than a long dispute over a narrow point.
