Scope: Bank accounts and funds in mainland China

A transfer fails and the bank says the account is frozen. You assume the branch can restore access if you provide an explanation. That may be wrong if the restriction comes from a court or an investigating authority.

When a China bank account is frozen, identifying the source of the restriction is the first task. A bank’s compliance review, a civil preservation measure and a criminal-investigation freeze involve different procedures.

Obtain the available details

Ask the bank what it can disclose about the restriction: reference number, issuing authority, date, scope and affected amount. Preserve notices and the record of communications. Clarify whether the entire account is restricted or only specified funds or functions.

Avoid relying on descriptions relayed through several intermediaries. Record information that remains unconfirmed.

Build the transaction explanation

Collect the underlying contracts, invoices, payment confirmations and records showing the commercial purpose of affected transfers. Reconcile the parties and amounts. Explain any third-party payment with supporting evidence rather than an improvised story.

For business accounts, identify the account holder’s legal identity and the person authorized to act. Counsel will need the correct authority to communicate or submit materials.

Choose the procedure after identifying the measure

China’s civil and criminal procedural laws provide different frameworks for preservation or investigative measures. A request to the bank cannot substitute for an application to the authority empowered to decide the matter. Civil Procedure Law; Criminal Procedure Law.

Depending on the facts, counsel may assess clarification, objection, review or another lawful application. The appropriate route and prospects cannot be determined from a failed payment screenshot alone.

Protect the business while the issue is reviewed

Record urgent obligations and discuss lawful operational options. Do not route transactions through personal or unrelated accounts to evade the restriction. No adviser can legitimately promise a fixed release date without the authority’s decision.
