Scope: Mainland China account restrictions; transaction-specific review
You supplied real goods and received the agreed price. Later, the payment is linked to an account restriction. Your team believes the invoice should be enough to prove the money is legitimate.
For China frozen funds transaction evidence, the strongest starting point is a coherent record of the entire transaction. The authority may need to understand why the money arrived, who sent it and how it connects to the underlying business.
Build a chain from order to payment
Link the customer inquiry, contract, invoice, delivery record and bank receipt. Identify dates, quantities and amounts consistently. Include communications authorizing payment and confirming performance.
If the payer differs from the customer, preserve the explanation and any prior instructions. Do not create backdated authorizations to fill a gap. Mark what was known at the time and what was learned later.
Identify your actual role
Were you the seller, an agent, a service provider or a payment recipient for another entity? Explain the arrangement accurately. Separate your own knowledge from statements made by the customer or intermediary.
Keep copies of relevant due diligence and account-opening records. An ordinary-looking payment can still require factual clarification; receipt of money does not establish criminal responsibility by itself.
Respond through the correct channel
Determine the restricting authority and procedural basis before submitting a large document package. China’s Criminal Procedure Law includes rules concerning investigative freezing measures; civil and bank-review situations require their own analysis. Official Criminal Procedure Law.
Counsel can help organize the explanation, identify missing evidence and assess an appropriate application or communication. Avoid sending inconsistent accounts to multiple offices or paying anyone who claims unofficial influence over release.
Use the incident to improve payment controls
Review unexplained payer changes, unusual payment splitting and requests to refund money to a different account. Establish escalation steps for future exceptions without assuming every third-party payment is unlawful.
