Scope: China-connected personal and commercial legal questions
“Can I get my money back?” is a reasonable question. The useful answer, however, depends on who owes it, what documents exist, which law applies and whether there is anything to recover.
A China legal consultation should help you decide what to do next. For an overseas client, that means a clear explanation of assumptions, options and the information still needed.
Give counsel a decision to help you make
Explain whether you are deciding to sign, pay, terminate, negotiate or start proceedings. Identify any deadline and its source. A legal question connected to a concrete decision is easier to scope than a large document upload with no explanation.
Prepare a one-page timeline and a list of relevant parties. Include the document that created the obligation and the communication that triggered your concern. Describe unfavorable facts openly.
Ask for an options comparison
A practical assessment should distinguish what is known from what must be checked. Ask counsel to compare the available routes by legal basis, evidence needed, cost drivers and commercial consequences.
For a dispute, the first step may be a targeted records request or negotiation rather than immediate proceedings. For a proposed transaction, it may be a condition that must be satisfied before payment. The appropriate sequence is part of the advice.
Understand when a formal opinion is appropriate
A short consultation and a formal legal opinion serve different purposes. If a bank, board or counterparty needs an opinion, specify the intended recipient, questions, factual basis and reliance requirements. Agree the jurisdiction and scope of the analysis before commissioning it.
Foreign-law questions may require advice from appropriately qualified counsel in that jurisdiction. Being based in Europe does not make every question an EU-law question, and a US issue may depend on state law.
Leave with an agreed next step
Request a concise action list: what to collect, who will act and when the position should be reassessed. Confirm the fee and scope for any additional work rather than assuming the consultation covers implementation.
Need a decision-focused starting point? Contact Jinyuan Law Firm with the countries involved, a short summary and the decision you need to make. The firm’s consultation service includes legal advice, written opinions, document drafting and non-litigation dispute assistance within an agreed scope.
General information only. Advice depends on the facts and applicable jurisdiction. Contact does not by itself create a lawyer-client relationship. Local-law advice may be needed outside mainland China.
