Divorce or Inheritance with Property in China: Start with an Asset Map

Scope: Mainland China assets; cross-border divorce and succession

A family matter begins overseas, but an apartment, company interest or bank account is in China. You have a foreign court order or a will and expect the transfer to follow automatically. The next steps may be more complex.

For cross-border family assets in China, start by separating ownership, the legal basis of your claim and the procedure needed to give effect to it. Divorce and inheritance raise different questions, even when the asset is the same.

Establish what the asset actually is

Collect available title records, purchase agreements, contribution evidence and company documents. Record registered ownership and any known mortgage or dispute. Distinguish personal assets from property owned by a company or another relative.

Mark missing information clearly. An address or a family recollection is an investigation lead, not proof of title.

In divorce, distinguish status from property consequences

Recognition of a foreign divorce and implementation of a property arrangement are separate issues that need review. Identify the orders actually made and the location of the assets they address.

If children are involved, treat care, contact and travel arrangements as distinct issues. Do not assume an asset settlement authorizes relocating a child across borders. Obtain advice before taking a step that could affect the child’s situation or ongoing proceedings.

In inheritance, organize the succession record

Gather the death record, will or other succession documents, relationship evidence and asset records. Identify other potential heirs and any existing proceedings. A foreign probate document may require additional assessment before it can support action in China.

China’s Civil Code contains separate marriage, family and succession provisions. Cross-border cases also require analysis of applicable law and document requirements. Official Civil Code.

Agree the next achievable step

The immediate task may be obtaining records, assessing an order or resolving a dispute among family members. A transfer should not be promised before the legal basis and required procedure are established.
