Scope: China-connected international couples; country-specific advice
You have discussed the wedding location and where to live. Less attention may have gone to an apartment in China, a family business or savings held in several countries. These questions become harder to resolve after a disagreement.
A China prenuptial agreement can be part of the discussion, but cross-border planning should examine the whole picture: marriage registration, assets, debts and the jurisdictions likely to matter later.
Begin with an accurate asset and residence map
List significant property, business interests, debts and family contributions. Record who owns each asset and where it is located. Distinguish existing property from plans for future purchases or business growth.
Discuss the countries where you expect to live. A document prepared for one jurisdiction should not be assumed effective everywhere you may later seek to rely on it.
Make property expectations explicit
Questions worth discussing include how expenses will be shared, how a jointly funded purchase will be documented and what happens to contributions from parents. A lawyer can translate those intentions into a legally appropriate arrangement and identify issues requiring advice elsewhere.
China’s Civil Code addresses marital property and written property agreements. Its application to a cross-border couple also requires consideration of relevant conflict-of-laws rules and facts. Official Civil Code, marriage and family provisions.
Plan registration as a separate task
Check eligibility and the document requirements of the actual registration authority. Confirm identity, civil-status evidence, translation and authentication requirements before arranging travel. Requirements should be verified for the relevant place and current procedure.
Allow time for informed decisions
Avoid presenting a complex agreement immediately before the ceremony. Each person should understand the terms and consider independent advice where appropriate. Keep the factual disclosures and final signed version organized.
