CIETAC arbitration is a leading institutional route for resolving China-related commercial disputes, but foreign companies must follow the applicable rules, arbitration agreement and procedural timetable. A company searching for a CIETAC arbitration lawyer usually needs to know how to file, respond, select arbitrators, present evidence, seek preservation and convert an award into recovery.
What is CIETAC arbitration?
The China International Economic and Trade Arbitration Commission administers domestic and international commercial disputes under its rules. The CIETAC Arbitration Rules currently published by the institution took effect on 1 January 2024. Parties should confirm which edition applies to their case.
Before commencing a case
- verify the arbitration clause and parties;
- identify claims, defenses and counterclaims;
- check limitation and contractual notice requirements;
- organize evidence and Chinese or English translations;
- calculate the amount claimed, interest and requested relief;
- assess property or evidence preservation;
- plan settlement authority and enforcement.
Starting the arbitration
The claimant prepares the request for arbitration, supporting agreement, statement of facts and claims, evidence and required fees. The respondent must organize its defense and any counterclaim within the applicable timetable. A procedural calendar should be treated as a management document with clear internal owners.
Selecting the tribunal
Consider legal experience, industry knowledge, language, independence, availability and the dispute’s technical features. The chosen procedure may involve a sole arbitrator or a three-member tribunal. Selection should follow the arbitration agreement and CIETAC rules rather than assumptions from court litigation.
Evidence, hearing and advocacy
Prepare an issue-based evidence map connecting every requested remedy to proof. Anticipate objections concerning authenticity, relevance and weight. The official Arbitration Law provides that parties support their arguments with evidence and may examine evidence at the hearing. See the Supreme People’s Court’s official arbitration evidence provisions.
Interim measures
If assets or evidence may disappear, evaluate preservation early. Identify the property or evidence, urgency, competent court and required security. An improper application can create liability, so the request must be supported and proportionate.
Settlement during arbitration
Parties can negotiate throughout the proceeding and may seek mediation where appropriate. A settlement should address payment security, confidentiality, releases, costs, default and whether the tribunal should record agreed terms in an enforceable form.
Illustrative case: the counterclaim changed the timetable
This is an anonymized composite example; it is not a reported award.
A foreign buyer commenced arbitration over defective equipment. The Chinese supplier responded with a counterclaim for unpaid milestones. Counsel rebuilt the project chronology, separated acceptance from payment events and coordinated technical evidence with the hearing plan. Early identification of the counterclaim risk allowed management to reassess settlement before incurring the full hearing cost.
CIETAC arbitration preparation checklist
- Confirm the clause and applicable rules.
- Build a chronology and claim-defense matrix.
- Preserve native electronic and technical evidence.
- Choose arbitrator criteria before nominations are due.
- Evaluate preservation and enforcement assets.
- Set reporting, budget and settlement authority.
