Scope: Mainland China civil disputes; overseas parties
Your supplier writes that the shipment was defective and promises to discuss a refund. You save a screenshot. A month later, the contact leaves the company, the account name changes and the supplier says the message was only a personal opinion.
For businesses considering WeChat evidence in China, the important question is what the record can reliably establish. A useful message still needs to be connected to the person, the business and the disputed transaction.
Keep the conversation around the helpful sentence
Preserve the surrounding discussion, dates, attachments and relevant account information. Keep the original records available where possible, together with the device or account through which they were obtained. Avoid cropping away qualifications or replacing original files with edited presentation slides.
The Supreme People’s Court’s civil evidence provisions expressly include instant messaging and similar communications within electronic data. They also address originals and assessment of electronic-data authenticity. Recognition of the evidence category does not mean every screenshot is conclusive. Official evidence provisions.
Explain who was speaking and in what capacity
Collect existing records that connect the account to the individual and their role: introductions, business correspondence, agreed contact lists or previous transactions. Distinguish your own knowledge from assumptions. A display name alone may leave important questions unanswered.
Ask counsel to assess whether the statement can be attributed to the company and what it actually acknowledges. A sales contact agreeing to investigate a complaint is different from an authorized acceptance of a specified debt.
Link the chat to the commercial record
Prepare a timeline alongside the purchase order, specification, delivery record, inspection result and payment evidence. Identify the invoice or batch being discussed. If several orders appear in the same conversation, make the connection explicit rather than asking the reader to guess.
Preserve voice messages and original attachments as well as text. Discuss translation, transcription and any additional preservation steps with counsel before filing. Requirements and useful techniques depend on the evidence and the procedure; notarization should not be treated as a universal cure for missing context.
Keep collection lawful and proportionate
Use records you are entitled to access. Do not enter another person’s account or alter source material to improve the apparent claim. Organize a working copy for review while retaining the underlying record. Tell counsel about missing messages or gaps early.
Does a chat admission support your claim? Request an evidence review from Jinyuan Law Firm with a short timeline and a description of the records available. Ask which facts the messages support, what remains unproven and how to preserve the material before a civil claim or settlement discussion.
